Quality Requirements in the Product Safety Act

This page provides information on the quality requirements for electrical products in accordance with the Product Safety Act (Produktsicherheitsgesetz, ProdSG).

The Act on the Provision of Products on the Market (Product Safety Act - ProdSG) regulates the provision, issuance and first-time use of products on the market. It serves to adapt German legislation to the Regulation (EC) No 765/2008 on accreditation and market surveillance. At the same time, several safety directives are incorporated into German law as ProdSG regulations.

With regard to the nature of electrical products, two internal directives are particularly important: The Low Voltage Directive and the Machinery Directive. These directives were incorporated into German law as First and Ninth Ordinance on the ProdSG (ProdSV).

Furthermore, the ProdSG regulates quality requirements for electrical products which are not subject to any of the above regulations and which are not regulated by law, as well as for used electrical products.

The following products are excluded from the scope of the ProdSG:

  • antiques (for example, technical-historical products),
  • used electrical products which must be repaired or reconditioned before use, if sufficient information is provided,
  • electrical products exclusively intended for military use,
  • medical products in the sense of § 3 Medical Devices Act.
