Quality requirements in the Product Safety Act

Considering the Low Voltage Directive and the Machinery Directive

Here you will find information on the quality requirements set to electrical products in accordance with the Product Safety Act (ProdSG).

The Act on the Provision of Products on the Market (Product Safety Act - ProdSG) regulates the provision, issuance and first-time use of products on the market and serves to adapt German legislation to the Regulation (EC) No 765/2008 on accreditation and market surveillance. At the same time, several safety directives in the form of the ProdSG regulations are incorporated into German law.

With regard to the nature of electrical products, two internal directives - the Low Voltage Directive and the Machinery Directive - which are implemented within the framework of the ProdSG, are particularly important. These directives were incorporated into German law as First and Ninth Ordinance on the ProdSG (ProdSV).

The Quality Requirements for electrical products which are not subject to any of the above regulations and which are not regulated by law, as well as used electrical products, are regulated by the ProdSG itself.

The following are excluded from the scope of the ProdSG:

  • antiques (for example, technical-historical products),
  • used electrical products which must be repaired or reconditioned before use, if sufficient information is provided,
  • electrical products exclusively intended for military use,
  • medical products in the sense of § 3 Medical Devices Act.
