Application for confidential treatment of the chemical identity of substances in preparations / mixtures
Even so Regulation (EC) No 1272/2008 on Classification, Labelling and Packaging (CLP Regulation) has entered into force, requests for use an alternative chemical name pursuant to Article 15 of Directive 1999/45/EC (Dangerous Preparations Directive) may be submitted to the Federal Office for Chemicals until 31 May 2015.
In principle two procedures are possible to submit an application for confidential treatment of the chemical identity of substances in preparations / mixtures until 31 May 2015:
- Under Regulation (EC) No 1272/2008 on Classification, Labelling and Packaging (CLP Regulation) an application can be submitted to the European Chemicals Agency (ECHA) in Helsinki (the process is currently being established)
- Under Article 15 of Directive 1999/45/EC (Preparations Directive) an application has to be submitted to the Federal Office for Chemicals. The approved alternative name can also be used beyond 31 May 2015.
From 1 June 2015 onwards the ECHA in Helsinki is exclusively responsible for the procedure.
